Review Topic: Adjustment of Status

Our K1-->AOS interview occurred on March 30, 2023. After checking in and doing yet another round of fingerprints, we sat for maybe 15 minutes before we were called to the back. It turns out that none of our biometric appointments yielded usable fingerprints, so we were initially concerned when we were asked to sign a witnessed statement that revolved around criminal acts, but it turns out that if they can't get fingerprints then they will make you sign this form and retrieve police clearance certificates for all locations at which you have lived for the previous 5 years. Unfortunately, you will only learn this during the interview so they will be unable to approve or deny you until you get an RFE for the police clearance certificates. Beyond that, the interview was surprisingly simple. We were only asked very simple questions regarding the relationship - what's your spouse's birthday, how did you meet, what are the names of your spouse's parents, etc. The immigration officer never asked to see any pictures or evidence besides our driver's licenses. I really can't say if this is because we already 'proved' our relationship at the K1 stage or if this immigration officer just didn't feel like he needed to ask many questions. My only knock against the process is that it would have been nice to know about the biometrics issue so that we could have prepared the police clearance certificates in advance. Our RFE appeared in our account the same day as the interview, we sent the response early the next week, and we were approved 10 days after they allege to have received our response. .

It was easy, on time, people in the FO were nice and it wasn’t busy at all.
Was just asked how we met, what was the wedding like and if we have any documents to share. We submitted my medical.
Wasn’t approved on the spot, was given paperwork to say my case is in review and that I can follow up after 120 days for updates.

Our appointment went very well and the officer who interviewed us was friendly and warm. It both felt like an interview and just a formality because he seemed to already have a positive opinion of our case. He only took 2 papers out of the 2" worth of evidence and forms we brought with us in a binder. He seemed surprised that after he went over all the questions on the i-485 form that there were no errors and he didn't have to change anything. He was very impressed with our evidence we had previously provided, how thorough we were and how we presented our evidence we brought with us. He literally refused to take anything besides a copy of our sons birth cert. and his paternity test. He didn't want the updated I-864's or taxes or paystubs or proof of our relationship. I offered to provide proof of his insurance which was new, for the i-944 and he said "nah, you don't need it, its a stupid form (i-944) anyway." YES he actually said that. 😮 He said he wasn't going to split our folder into two (the one he had) because we already have so much and it's so full, so he basically didn't need anything else. He did want to look at the photos but he didn't keep any. He didn't ask any crazy questions, most of the questions were just going over the I-485 to make sure we didn't miss anything. He asked who our joint sponsor was, he asked about the age of our son and when we met, how we started talking, when we started dating, how many children I have (he asked me that), if I ever met his parents what their names are and where they live, and asked how long I was with him in Australia. All the questions were really easy and he wasn't trying to trick us or find a reason to deny us. He told us they don't do approvals on the spot and said we should know in 1-2 days. About an hour and a bit after the interview our status finally updated to "New Card Being Produced!" YAY!!

Showed up 15 minutes before the appointment. Security was quick super nice and joked a little.

We got to #501, gave them the appointment letter and sat down. About a 15 minute wait and only a few people already there. Interview was pretty straight forward.

Husband (petitioner) was asked:

-His name
-When I was born
-Where I was born
-If he had started working yet
Then a bunch of questions off the 485.

Asked me:
-His birthday
-His parents names

Then he asked us how we met, when/who proposed, how many times we had seen each other before him moving here January this year. The gentleman was super nice, made small talk, and shared some cat stories. He didn't want any of our co-mingling evidence I had brought. He took our wedding photos and was impressed our cat wanted to wear a bowtie as our ringbearer lol.

Just back home from the AOS interview, which took around 15-20 minutes.

Parking:

There is a parking garage just around the corner. Turn right on East Lakeside and an immediate right just past East 10th. It’s like almost immediately after turning right on East Lakeside. So watch for it. $8 to park. The walk to the Federal building from there is quick.

Entry:

Construction around the building makes getting in a little tricky. We had to walk through a makeshift path in a flower bed. Not many in there. Security asked what we were there for. After we told them, they said to have a seat, that it would be ten minutes before we could go up.

Fifth floor (501):

There are signs pointing to room 501. It’s kind of hard to miss it. We presented our appointment paperwork and the nice lady at the desk told us to have a seat and someone would be right out.

Interview:

We were not separated. The lady who did our interview was professional, sweet, and very personable. She exchanged small talk with us about the Covid procedures around the state as well as some personal chit chat about us and herself. She really made it seem less like a formal interview and more like a conversation.

She began with looking at our ID’s and we took the oath affirming that we would tell the truth. Then she immediately went into the list of I-485 questions, she asked about 15 of those.

Then the following:
- my full name (petitioner)
- current address
- my parents names
- when we married
- had I ever been married before
- do I have kids

Then she asked my husband the same questions.

Then she asked questions from the I-944:

- if I had been on public assistance
- how many people live in the house
- have I been working

Then she asked how we met, whether my husband traveled to my country or not. We explained and she took copious notes.

She asked what was next for us. We talked about getting a job now and being part of a community.

She mentioned that Cleveland is the fastest office in the nation for turning around green cards.

She asked if we had other materials we would like to present but said that she has more than enough. So we gave her nothing. Honestly, we prepared so much stuff and used absolutely none of it. Not complaining.

Final thoughts:

All in all it was a very pleasant experience. Just one minute or so after walking out of the building, my case updated to say “New card is being produced”.

I think we passed!

**EDIT: we did**

Good luck everyone!
